This website is managed by Tommaso Starace. Tommaso Starace offers this website, including all information, tools, services, and sells selected products available on this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. The following terminology applies to these General Terms (Terms and Conditions, Terms of Service), Shipping and Returns, Privacy Policy, Disclaimer, and all Agreements: "Customer", "Buyer", "You", "Your" and "User" refer to you, the person accessing this website and complying with the company's terms and conditions. "The Company", "We", "Our", "Us", "Me", "I", "Shop", "ParresiArt", "www.parresiart.com" and "Tommaso Starace" refer to our Company. "Part" or "Parties" refers to both the Customer and ourselves. All terms also refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Customer in the most appropriate manner for the express purpose of meeting the Client's needs in respect of the provision of the Company's stated products and services, in accordance and subject to current Italian law. The use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms", "Service"), including any additional terms or conditions and policies referenced or made available via hyperlink. These Terms of Service apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content, institutions, state or parastatal agencies, and foundations.

Credit card information is always encrypted during transfer over networks. SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

The prices of the Products are those indicated on the website www.parresiart.com at the time of connection. All prices are in Euro and include VAT. The prices of our products are subject to change without notice. Tommaso Starace reserves the right to change the prices in the catalog, without prejudice to contracts already concluded before the date of the catalog modification. No price changes will apply to orders currently being processed. We reserve the right, at any time, to modify or discontinue the Service (or any part or content thereof) without notice at any time. We will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

 

SECTION 5 - PRODUCTS, SERVICES, CONSERVATION, AND MAINTENANCE

Specific Products or Services may be available exclusively online through the website. Some products or services are unique, others may have limited quantities, and some are made to order; all types of products and services are subject to return or exchange only in accordance with our Refund Policy. Please read our Shipping and Returns Policy (Refund section). We have made every effort to display as accurately as possible the colors and images of our products that appear on the www.parresiart.com store. We cannot guarantee that your computer monitor's display of any color or detail will be accurate. Tommaso Starace delivers to the Customer a Product that complies with the contract, meaning it corresponds to the description, by images or in writing, present on the website www.parresiart.com. The dimensions are approximate to those indicated on the site and may undergo physiological variations, due to the stretching and cutting of the canvases (framing and cutting), in the order of +/- 2 cm, to printing processes, in the order of +/- 5%, to minimal measurement errors without prejudice to the price to which they refer. Small differences in the Product compared to what is described on the website www.parresiart.com cannot be contested.

Tommaso Starace provides no warranty:

(a) if, at the time of concluding the contract, the Customer was aware of the defect in the Product, or could not have ignored it with ordinary diligence, or the lack of conformity arose from instructions or materials provided by the Customer, that is, the files or materials transmitted or sent for the realization of the product(s) contained errors that were not recognizable by Tommaso Starace;

(b) for delays in delivery, or for defects of conformity, attributable to the courier, who is responsible for the loss or damage of things delivered to him for transport, from the moment he receives them until he delivers them to the customer;

(c) if the lack of conformity is not original or does not exist at the time of delivery of the Product, but occurred for reasons not attributable to Tommaso Starace;

(d) if the lack of conformity is known or recognizable by the Customer/s and/or they accept the Product at the time of delivery or receive it without any reservation or without performing any check.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All descriptions of products or product prices are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not guarantee that the quality of any products, services, information, or other materials purchased or obtained by you will meet your expectations, nor that any errors in the service will be corrected.

Due to the nature of paintings and artworks, the customer must exercise utmost care in the proper conservation and maintenance of these products. Paintings and artworks, in general, should not be touched, scratched, bumped, exposed to direct sunlight, exposed to chemicals or mechanical, environmental, chemical, or physical stress such as sudden temperature changes, extreme temperatures, dust, humidity, or pressure. It is solely the responsibility of the customer to properly preserve the purchased goods. Any intentional or accidental damages or alterations, of any nature and extent, environmental, atmospheric, mechanical, structural, physical, or chemical, caused to the artworks by the customer or negligence after delivery to the customer, are attributable solely to the buyer. By accepting the Terms and Conditions of this website, www.parresiart.com, the customer releases Tommaso Starace, VAT number 10367651212, from any legal and economic liability related to damages or alterations suffered by the artworks after delivery to the customer. By accepting the Terms and Conditions of this website, www.parresiart.com, the customer also commits to periodically consulting (at least every three years) Tommaso Starace, www.parresiart.com, and/or to contacting an experienced art conservator/restorer, scheduling periodic maintenance sessions in order to constantly monitor and maintain the purchased artwork(s) in good condition. Constant consideration of the artworks will allow for their study over time, evaluating their environmental conditions and preventing damage before it is too late.

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change or cancel an order, we may attempt to notify you by contacting you via the email address and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

For all disputes concerning the interpretation or performance of the contracts, the competent court will be exclusively the Court of Naples, Italy.

SECTION 20 - LICENSE

Unless otherwise indicated, Tommaso Starace holds the intellectual property rights for all material on ParresiArt, www.parresiart.com. All intellectual property rights are reserved. You may access this material from ParresiArt for your personal use, subject to restrictions set in these terms and conditions. You must not:

Publish material from ParresiArt;

Sell, rent, or sub-license material from ParresiArt;

Reproduce, duplicate, or copy material from ParresiArt;

Redistribute content from ParresiArt.

This Agreement begins from the current date.

 

SECTION 21 - SHIPPING AND RETURNS

Please read our Shipping and Returns Policy, which applies to products purchased from us using the website. Customers in the European Union have the right to a legal withdrawal period of fourteen working days. Details of this legal right and an explanation of how to exercise it are available in the Returns Policy.

 

SECTION 22 - ORDERS

Orders can be placed through the website www.parresiart.com, accessible 24 hours a day, 7 days a week, or by directly contacting our offices (phone: +39 344 419 7222, email: info@parresiart.com). Orders for original (unique) or reproducible artworks available on the site, unless otherwise specified, are automatically considered accepted under the conditions proposed on the site and will be processed after receiving payment (in the case of payment by bank transfer, refer to the conditions specified in Section 23 - Payments). Preparation for the delivery of unique original works usually takes place within 15 working days from receipt of payment; they are framed upon customer's request expressed through the act of purchase and adherence to this service; they are packaged in custom-made wooden boxes prepared at the time of the customer's order, carefully padded; they are covered by ParresiArt against theft and/or damages. Orders for fine-art or Giclée prints, from open edition series, on canvas, barite paper, or other support, framed or unframed, are made upon customer's request expressed through the act of purchase and are usually ready for delivery within 15 working days from receipt of payment; they are packaged in double-walled resistant cardboard boxes and padded with bubble wrap and Styrofoam sheets. Fine-art or Giclée prints from limited edition series are framed upon customer's request expressed through the act of purchase and are usually ready for delivery within 15 working days from receipt of payment; the type of packaging for limited edition series works varies according to the size, type, and value of the work.

For clarification or more information regarding your specific order, you can contact us at our telephone or email contacts. You will be informed of the status of your order and receive a shipping notification when your order is delivered to the courier, but you can contact us at any time for an update by sending an email to postmaster@parresiart.com.

The preparation and delivery times expressed on the website are always understood as working days (excluding Saturdays), are purely indicative, and subject to changes. Preparation for delivery times starts from the moment of payment or from the moment of credit. The times calculated on the product page refer exclusively to the times for the preparation of the product itself for shipment (preparation of the product by ParresiArt or third parties and delivery to the express courier) and do not include actual delivery times (understood as the actual delivery of the product by the courier to the customer). Usually, courier delivery times to the customer vary from approximately 2 to 4 working days for Italy, from 3 to 5 working days for Europe, from 5 to 7 working days for the rest of the world, excluding any customs delays.

All shipments are traceable from the moment the courier takes charge.

In the case of international shipments and/or for artworks of non-standard dimensions and/or weight, the shipping cost, always borne by the customer, may not be visible at the time of purchase. In such cases, we recommend contacting us using our contacts for clarification and verification before making the payment. Within two working days of receiving your request or order, we will contact you by phone or email to advise and discuss the delivery of your order.

 

SECTION 23 – PAYMENTS

Customers can make payments using the following methods: credit cards, Shopify Payments, PayPal, Apple Pay, bank transfer, or bank draft payable to Tommaso Starace.

If payment is made via bank transfer or bank draft, the order will be processed upon receipt of credit, typically within 2-5 days after the transfer or deposit of the bank draft (times may vary depending on the Credit Institute used).

 

SECTION 24 - CUSTOMS DUTIES

If you're ordering goods to be delivered outside the European Union, please note that your shipment may be subject to customs duties and taxes, which are applied once the goods reach the destination country. Any fees related to customs clearance must be borne by you. You agree that Tommaso Starace has no control over any additional charges related to customs clearance. We advise you to check with your local customs officials or post office for more information regarding import duties/taxes that may apply to your online order. Upon your request, we may, but are not obligated to, assist you in understanding such costs. You will be the importer and therefore responsible for any import duties and customs taxes. Furthermore, all expenses related to customs clearance will be your responsibility as the customer. Please note that during the shipment of goods from Italy, parcels may be subject to opening and inspection by customs authorities. Regarding all goods sent to an address outside Italy, you are considered the importer of the goods and must therefore comply with all laws and regulations of the country to which the goods are delivered.

 

SECTION 25 – MINORS

Tommaso Starace, www.parresiart.com, does not sell products for purchase by minors. We sell products that can be purchased for minors by adults. If you are under 18 years old or have not reached the legal age in your state or province of residence, you can only purchase from this website with the involvement of a parent or guardian.

 

SECTION 26 - EVENTS BEYOND OUR REASONABLE CONTROL

Tommaso Starace will not be liable for any delays or failure to meet our obligations under these conditions if the delay or failure results from causes beyond our reasonable control. This condition does not affect your legal rights.

 

SECTION 27 – COPYRIGHT AND TRANSFER OF THE WORK TO THIRD PARTIES

Given that the parties agree as follows:

this contract is valid for itself, for its heirs, and any assigns;

the Artist engages in the production of visual artworks;

the Artist is the author of all the works present on this website, www.parresiart.com, and the purchase of one or more unique works by the buyer commits the parties to these provisions:

the Artist intends to transfer the work(s) (hereinafter singular) to the Buyer who wishes to purchase it;

the Artist declares to be the exclusive owner of the copyright on the work and that it is their exclusive creation;

the Artist guarantees that the work is not subject to or burdened by rights and/or constraints of any kind in favor of third parties, which may affect, in whole or in part, the Buyer's property rights;

pursuant to art. 103 and following of Law 633/1941, the work(s) has been deposited and registered with the Public General Registry of Protected Works (the day and registration number of the specific purchased work(s) will be communicated to the buyer in a separate email after the purchase);

the parties declare to be aware of and accept the copyright laws protecting intellectual works, and in particular the provisions recognizing, in case of transfer of ownership of the work, the persistence of moral rights and economic utilization rights in favor of the author, including the resale right, that is, the author's right to receive compensation on the price of each subsequent sale after the first transfer of the work by the author, pursuant to articles 144 and following of Law 633/1941.

The parties agree and stipulate as follows:

The preamble is an integral and substantial part of this contract, therefore the parties undertake to fully comply with it.

The Artist transfers to the Buyer who accepts ownership of the work identified in the purchase transaction, in consideration of the price indicated on the website www.parresiart.com at the time of purchase and under the conditions stipulated below.

The price is agreed upon by the parties in the amount indicated on the website www.parresiart.com at the time of purchase and inclusive of VAT, payable in a single installment.

The Artist remains the sole owner of the work until full payment of the sale price.

The Artist undertakes to deliver the work within the indicative times established by this contract (please refer to our Shipping and Returns policy), excluding possible delays due to force majeure not attributable to Tommaso Starace, at the location indicated by the customer.

The transportation of the work and transport insurance shall be at the Buyer's expense.

The Artist provides the Buyer with a certificate of authenticity of the work.

COPYRIGHT

The parties agree that, with this private document, the Artist does not transfer any of their economic utilization rights in the work, which therefore remain fully available to them, for all countries and for the entire duration of the copyright.

Therefore, the Buyer must request the Artist's authorization for any reproduction, publication, or communication to the public of the image of the work.

In order to exercise economic utilization rights, the Artist declares to have made reproductions (video, photographic, and digital) of the work before delivery.

The parties agree on the Artist's right to have access to the sold work in order to make any further reproductions, to be exercised within reasonable limits and subject to agreement on the modalities to be defined from time to time with the Buyer.

The Buyer undertakes to lend the work to the Artist for a period of 60 days, even non-continuous, every 3 years (for example, for participation in exhibitions). An extension of the term must be authorized in writing by the Buyer at their discretion. The packaging, transportation, and insurance of the work for damages resulting from theft, fire, damage, and destruction, even if a third party has possession, shall be at the Artist's expense and responsibility, for the entire duration of the loan, from delivery to the return of the work.

The Artist undertakes to include the Buyer's name, if agreed upon, in the exhibitions for which the work is loaned and in the catalogs and other promotional materials on which it will be reproduced.

The Buyer has the right to exhibit the work in both private and public exhibitions, provided they have obtained authorization from the Artist. To this end, the Buyer must send a request to the Artist containing the period, location, characteristics, and participants in the exhibition. The Buyer shall be deemed authorized if the Artist does not communicate their refusal within 30 days of receiving the request. The Buyer must also pay the Artist 20% of any fees received for the exhibition of the work, within 60 days of collection.

The Buyer undertakes to include the Artist's name, year of creation, and title of the work in public presentations of the work as per article 4.7 and in reproductions, publications, or communications to the public of the image of the work as per article 4.2.

Any specific assignments of economic utilization rights must be the subject of a separate written contract.

DAMAGE AND DETERIORATION OF THE WORK

The Buyer undertakes not to alter, damage, or destroy the work and to adhere to the conservation and maintenance methods indicated in SECTION 5 - PRODUCTS, SERVICES, CONSERVATION, AND MAINTENANCE of this contract.

In case of deterioration of the work, the Buyer shall promptly notify the Artist, with whom they shall agree on the methods of any necessary repair interventions, to be carried out at the Buyer's expense.

TRANSFER OF THE WORK TO THIRD PARTIES

In case of transfer of ownership of the work to third parties, the Buyer undertakes to immediately inform the Artist thereof by written notice indicating the name, surname, telephone contacts, email, and domicile of the third parties.

The Buyer must ensure that the third party accepts all the clauses contained in this contract or General Conditions. In case of non-compliance, the Buyer must pay the Artist, by way of penalty, an amount equal to the purchase value at the time of purchase, in addition to any further damages.

LOSS OR THEFT

By accepting the Terms and Conditions of this website, www.parresiart.com, the customer undertakes to pay the artist, in case of loss or theft of the artwork(s) after delivery to the customer, by way of penalty, an amount equal to the purchase value at the time of purchase, in addition to any further damages.

FINAL PROVISIONS

Italian law applies to this contract.

Any modification to this contract or additional agreement must be in writing.

For matters not covered in this contract, express reference is made to the provisions of Italian copyright law, the Civil Code, and special laws concerning the protection of artworks.
